    As we at RedState have covered extensively, California’s new anti-freelancing law, AB5, has had devastating “unintended” consequences for tens of thousands of professionals who make a living (or supplement their income) as an independent contractor. Billed as a law to protect people driving for Uber, Lyft, and the like from being exploited, it instead has impacted over 150 industries, including community theaters, court translators and interpreters, court stenographers, writers, wedding planners, photographers, transcriptionists, and more.

    While resistance to the law and calls for repeal have grown in frequency and volume, Lorena Gonzalez, the bill’s author, remains unfazed. Her attitude toward those who have been harmed hasn’t changed a bit from what we observed in December. In fact, she won’t even admit that people have been harmed.


    Needless to say, this attitude infuriates those impacted by AB5. A number of the bill’s opponents showed up Saturday night to an event at which Gonzalez was scheduled to appear, armed with signs and prepared to respectfully show Gonzalez and the crowd that real people and real families are being hurt by her cruel law.

    When Gonzalez stood up to speak to the crowd, the group stood quietly with their signs. When she realized what the signs said, her reply was to shout, “F**k Trump!” Alitzah Wiener-Dallas, a member of the Freelancers Against AB5 Facebook group, described the scene:

    She confidently walked out and started to speak to the crowd. As she started talking the signs started popping up. I was in full eye view with her and never took my eyes off of her. We were all quietly holding our signs But you can tell she was now scanning the audience trying to read the signs because the flow of her speech started to slow down, when she then yelled out (with kids in the front row) F@@@ Trump (that’s right her immediate go to)

    Her crowd yelled and at the moment we then started the chant, Repeal AB5! We got louder and louder. She got quiet. Her crowd was looking, watching all of us. At that moment she had lost control of her stage she was quickly trying to figure out what to say. So after a couple seconds of her saying nothing her next come back was …”Seems like there is a lot of Trump supporters here tonight. We don’t need them in this arena tonight!”

    After a few minutes, Gonzalez introduced the evening’s main speaker, Julian Castro, and the Repeal AB5 crowd stopped chanting out of respect for Castro. But there were good conversations had with other audience members who were unaware of how devastating the impact has been for so many Californians, and who were unaware that opposition to the law is bipartisan.

    So, here's the thing. The issue of who is an independent contractor VS an employee is a briar patch few bureaucrats want to mess with.
    The IRS has, several times, tried to provide guidance, with limited success.
    FedEx among others, has had a long running battle with the IRS about what, exactly, constitutes the difference between an independent contractor and an employee. The bottom line is, the IRS wants it's tax money, and by the time most cases get to the hearing stage, the only hope to get it is from the employer, so employers face a steep hill proving that someone is an independent contractor.

    In any case, Shooter got himself involved in a case years ago about whether strippers in a club were independent contractors or employees. The checklist has changed some, but consider trying to answer the following points with a straight face, if you're a club owner or for that matter, a stripper...……… The law judge in this case literally had to keep stopping the hearing to leave the room while he regained his exposure. Pretty much everyone in the hearing was glad for the opportunity as well.

    IRS 20-point checklist for independent contractors Mistakenly classifying an employee as an independent contractor can result in significant fines and penalties. There are 20 factors used by the IRS to determine whether you have enough control over a worker to be an employer. Though these rules are intended only as a guide-the IRS says the importance of each factor depends on the individual circumstances-they should be helpful in determining whether you wield enough control to show an employer-employee relationship. If you answer “Yes” to all of the first four questions, you’re probably dealing with an independent contractor; “Yes” to any of questions 5 through 20 means your worker is probably an employee.
    1. Profit or loss. Can the worker make a profit or suffer a loss as a result of the work, aside from the money earned from the project? (This should involve real economic risk-not just the risk of not getting paid.)
    2. Investment. Does the worker have an investment in the equipment and facilities used to do the work? (The greater the investment, the more likely independent contractor status.)
    3. Works for more than one firm. Does the person work for more than one company at a time? (This tends to indicate independent contractor status, but isn’t conclusive since employees can also work for more than one employer.)
    4. Services offered to the general public. Does the worker offer services to the general public?
    5. Instructions. Do you have the right to give the worker instructions about when, where, and how to work? (This shows control over the worker.)
    6. Training. Do you train the worker to do the job in a particular way? (Independent contractors are already trained.)
    7. Integration. Are the worker’s services so important to your business that they have become a necessary part of the business? (This may show that the worker is subject to your control.)
    8. Services rendered personally. Must the worker provide the services personally, as opposed to delegating tasks to someone else? (This indicates that you are interested in the methods employed, and not just the results.)
    9. Hiring assistants. Do you hire, supervise, and pay the worker’s assistants? (Independent contractors hire and pay their own staff.) 10. Continuing relationship. Is there an ongoing relationship between the worker and yourself? (A relationship can be considered ongoing if services are performed frequently, but irregularly.)
    11. Work hours. Do you set the worker’s hours? (Independent contractors are masters of their own time.)
    12. Full-time work. Must the worker spend all of his or her time on your job? (Independent contractors choose when and where they will work.)
    13. Work done on premises. Must the individual work on your premises, or do you control the route or location where the work must be performed? (Answering no doesn’t by itself mean independent contractor status.)
    14. Sequence. Do you have the right to determine the order in which services are performed? (This shows control over the worker)
    15. Reports. Must the worker give you reports accounting for his or her actions? (This may show lack of independence) 16. Pay Schedules. Do you pay the worker by hour, week, or month? (Independent contractors are generally paid by the job or commission, although by industry practice, some are paid by the hour.)
    17. Expenses. Do you pay the worker’s business or travel costs? (This tends to show control.)
    18. Tools and materials. Do you provide the worker with equipment, tools, or materials? (Independent contractors generally supply the materials for the job and use their own tools and equipment.)
    19. Right to fire. Can you fire the worker? (An independent contractor can’t be fired without subjecting you to the risk of breach of contract lawsuit.)

    New York Times ripped for column saying coronavirus should be called 'Trumpvirus'


    Democratic presidential candidate Amy Klobuchar discusses how her administration would handle coronavirus fears and being a moderate in the 2020 race.

    The New York Times was widely mocked on Thursday over an op-ed column that criticized the White House response to the coronavirus outbreak by declaring that the ailment should be referred to as "Trumpvirus."

    The piece by columnist Gail Collins was headlined, “Let's Call It Trumpvirus,” and declared that “if you’re feeling awful, you know who to blame.”

    “The New York Times is blaming coronavirus on Trump now ... when they should be blaming themselves for the outbreak of Trump Derangement Syndrome,” political satirist Tim Young tweeted.

    Fourth Watch editor Steve Krakauer captioned the column, “Our media is broken - perhaps irreparably so.”

    In the widely lampooned piece, Collins criticized Vice President Mike Pence, who has been assigned to lead the government's coronavirus response.

    “Well, it probably could have been worse. Having a czar does make you feel there’s somebody in charge. At least Trump didn’t come before the cameras and announce solemnly, ‘Today I’m asking every American to cross your fingers,’” Collins wrote.

    “Our president had to be going crazy over a problem that involves both declining stock prices and germs. This is the guy, after all, who thinks shaking hands is ‘barbaric,’ who is followed around by aides bearing sanitizer,” Collins wrote.

    The Times columnist then mocked Trump for blaming the financial markets on Democrats, misspelling coronavirus in a tweet, telling Americans that things are under control and not being as prepared as his predecessor.

    “Barack Obama used to have special epidemic-watching groups just in case this kind of crisis developed,” Collins wrote.

    “Chances are, if the president is encouraged to mix the subjects of coronavirus and Mexico walls, he’ll suddenly announce that we need a barrier much bigger and thicker and more expensive, so it can stop the flow of immigrant germs,” Collins wrote to end her column.

    Critics mocked the piece on Twitter.

    The column was published one day after the Trump campaign filed a libel lawsuit against what it called the "extremely biased" New York Times, saying the paper's March 27, 2019 op-ed titled “The Real Trump-Russia Quid Pro Quo" amounted to a knowingly false smear intended to "improperly influence the presidential election in November 2020."

    "They did a bad thing," Trump said at a coronavirus press conference later Wednesday, before apparently promising more litigation. "There will be more coming. There will be more coming.”

    Denver Democrat faces backlash after tweeting ‘solidarity’ for spreading coronavirus at Trump rallies

    Democratic Denver City Councilwoman Candi CdeBaca faced conservative criticism Tuesday after sharing a meme on Twitter suggesting she stands in “solidarity” with the idea of spreading coronavirus at President Trump’s campaign rallies.

    "These people are sick," Donald Trump Jr. tweeted.

    CdeBaca, apparently posting in jest, had retweeted a meme that said: “For the record, if I do get the coronavirus I’m attending every MAGA rally I can.”

    CdeBaca commented: “#solidarity Yaaaas!!” with laughing emojis.

    CdeBaca, based on her Twitter posts, appears to be a supporter of self-described democratic socialist Sen. Bernie Sanders, I-Vt., one of the leading candidates for the Democratic presidential nomination.

    Candi CdeBaca, Denver City Councilwoman, shared a meme suggesting those infected with coronavirus should attend "MAGA" rallies.

    Republicans quickly hit back, coming amid a partisan war of words over allegations that lawmakers are politicizing the response to the coronavirus.

    “This elected Democrat in Colorado doesn’t seem very nice!” the Trump campaign War Room Twitter account posted in response.

    “The depths to which Democrats are sinking to politicize coronavirus is disgusting," Republican National Committee Rapid Response Director Steve Guest said in a statement to Fox News on Tuesday. "Democrat leaders, both nationally and in Colorado, need to condemn this deranged comment.”

    The back and forth comes as the federal government grapples with the outbreak. Trump, over the weekend, authorized new travel restrictions and warnings in response to the coronavirus outbreak. The administration’s strict travel warning affects Iran, Italy and South Korea at this point.

    The virus has sickened 89,000 people across 66 countries, resulting in at least 3,061 deaths, including six in the U.S. Most of the deaths have occurred in mainland China.

    Trump, on Monday, was asked whether it was “safe” for him to continue to hold his campaign-style rallies as the country battles the virus.

    “You should ask the Democrats,” Trump said. “They’re all having rallies. They’re campaigning.”

    He added: “I think it’s very safe.”

    Barbra Streisand bashes Trump's 'breathtaking ignorance' in scathing op-ed

    Barbra Streisand wrote a scathing opinion column in which she took shots at Donald Trump’s record as president as well as his Republican colleagues in the Senate ahead of Super Tuesday.

    The outspoken 77-year-old penned a lengthy column in Variety in which she lambasted nearly every move Trump has made since winning the 2016 election.

    “No wonder doctors report that more people than ever are anxious and depressed. Since 2016, we’ve been dragged down into the mud of Trump’s swamp,” she wrote. “He has demolished our standing in the world with his laughable boasts and breathtaking ignorance. He has put the security of this country, and our planet, in a precarious position by abandoning the Paris climate accord and the Iran nuclear deal. He’s a one-man weapon of mass destruction … so reckless that he almost started a war.”

    She went on to criticize the president for his handling of the coronavirus, noting that he “got rid of our pandemic specialist two years ago and has defunded the Centers for Disease Control.”

    “We can’t go on like this. It’s too dangerous,” she added.

    Streisand noted that the public should have seen the writing on the wall with Trump as soon as he fired James Comey for “refusing to pledge loyalty to him, as if he were a king” before taking aim at Trump's recent string of presidential pardons.

    “But Trump thinks the rules don’t apply to him. He, and his appointees, have set a whole new level of misconduct,” she continued. “His recent spree of pardons looks like a transparent attempt to normalize his own corruption and pave the way for pardoning his cronies, who have lied for him. (He fires people who obey the law and tell the truth.)”

    From there the celebrity took more jabs at the president’s record, bringing up his approach to Healthcare that he mentioned at the State of the Union and his numerous trips to play golf at his own resorts despite promising on the campaign trail he wouldn’t do that. Streisand then compared Trump to his predecessor, arguing that the 44th president had a better record.

    “Trump can never live up to Obama’s legacy, so he’s trying to erase it. He inherited a growing economy and now claims credit for it, saying it’s the best in history … but that’s another lie. In fact, the GDP, job growth and the S&P 500 all rose faster under Obama,” she noted. “Meanwhile Trump, with his tax cuts for corporations and the very wealthy, has basically doubled the budget deficit to more than a trillion dollars — unprecedented in a time of prosperity. And he’s on track to add another 50% to the national debt, the fastest dollar increase in history. (That’s a pattern. Republicans leave it to Democrats to clean up their mess.)”

    She concluded by swiping at Trump for being emboldened by Republicans following his impeachment acquittal in the Senate and with a note to Democrats that may agree with her point of view to vote in the upcoming election.

    “Every day, he takes another swipe at the pillars of our democracy, but we cannot allow him to irrevocably change this country. The ‘beacon of hope’ that is America could be extinguished if he’s given another four years,” she concluded. “In this upcoming election, we must bring back dignity and grace. We must care about the facts, the planet, each other and the least fortunate among us.”

    Patricia Arquette says if Trump wins in 2020 we will face 'extinction' and 'destruction of our planet'

    Patricia Arquette took to Twitter on Wednesday to convince her followers to vote for Democrats in the White House, Senate and House in a series of three posts.

    The 51-year-old “The Act” star is rarely shy about posting her political opinions on social media. As results poured in following Super Tuesday, which saw former Vice President Joe Biden take a narrow lead over Sen. Bernie Sanders, I-Vt., Arquette took to Twitter to sound off on President Donald Trump and encourage people to lean left.

    “Donald Trump has done nothing but expedite Climate Change inducing policies with 4 more years that would only get worse. Say no to mass extinction and the destruction of our planet,” she wrote in the first of three tweets. “Vote Democrat.”

    She then introduced a hypothetical situation wherein Sanders is in a position to pass legislation, arguing that having Democrats control the legislative branch would be key.

    “Look at it this way- The strongest liklihood [sic] of Senator Sanders passing legislation is to have a Democrat in the White House, a majority Democrat Senate and House. Make it happen,” she tweeted.

    She then warned of potential attacks on women’s rights and a largely conservative Supreme Court if Trump wins the general election again.

    “Yoo Hoo. Women’s right to chose is hanging by a thread. DO NOT LET TRUMP WIN. You lose the courts for a generation you will lose many things,” she concluded.

    The star has been advocating for her fans to vote in the 2020 primaries for months, having previously devoted part of her acceptance speech at the 2020 Golden Globes to the cause.

    Arquette was one of the many celebrities to denounce Trump following his ordering of an airstrike that took the life of Iran top general Qassem Soleimani.

    "I beg of us all to give a better world," she added. "We have to vote in 2020 and beg and plead for everyone we know to vote in 2020."

    Former DNC chair Dean implies GOP Rep. Stefanik deserved 'vile' note: 'As ye sow, so shall ye reap'

    Republican Rep. Elise Stefanik is attacked by the media, Democrats and even celebrities after week one of the public impeachment hearings. Fox News contributor Tammy Bruce reacts.

    Former Democratic National Committee chair Howard Dean reacted to an offensive note left on the car of Rep. Elise Stefanik by implying that the New York Republican brought it on herself.

    Stefanik shared a photo of what she called a "vile" note which said, “Rot in Hell FASCIST PIG,” on Twitter Saturday, and she lamented “that the radical Far-Left cannot see beyond their vicious hate.” Dean retweeted it hours later with his own.

    “I don’t condone this, but ‘as ye sow, so shall ye reap,’” said Dean, a former governor of Vermont. “There is no excuse for the note writer or for you. You are a shame to your district and to a democratic United States.”

    This is not the first time that Stefanik has been the target of a Democrat’s ire. She became a favorite target of Democrats and liberals during the House impeachment inquiry late last year, particularly for becoming a thorn in the side of House Intelligence Committee Chairman Adam Schiff, D-Calif.

    One of the most explosive moments of the impeachment hearings came Nov. 15, 2019, when ranking member Rep. Devin Nunes, R-Calif., yielded some of his time to Stefanik. But as she spoke, Schiff slammed down his gavel, arguing that it was not allowed under committee rules.

    What followed was a debate between Nunes and Schiff as to whether the Republican could offer his time to a fellow member of Congress, rather than minority counsel. Stefanik repeatedly tried to speak, only for Schiff to bang his gavel again to silence her.

    Stefanik's performance at that moment and throughout the hearings earned her praise from fellow Republicans and likely contributed to her being named an honorary chair for the Trump 2020 Campaign in early January.

    Bette Midler accuses Donald Trump of lying about not having coronavirus

    Actress and notorious Donald Trump critic Bette Midler is accusing the president of lying about testing negative for coronavirus.

    As the world continues to make concessions to combat the growing COVID-19 outbreak, White House physician Dr. Sean Conley released a statement announcing to the country that President Trump has been tested and does not have coronavirus despite coming in contact with a few people who have the deadly virus.

    Midler, however, isn’t convinced and took to Twitter to question the tenacity of Dr. Conley’s statement.

    “You know, #Donald says he has tested negative for #Coronavirus. But why should we believe him? He has lied over 16,000 times in the last three years! Why would he not be lying now?” the star wrote.

    Although she didn’t cite her source, the number likely comes from The Washington Post’s running fact-check. Regardless, the star is clearly disputing the notion laid out by Dr. Conley in his statement.

    "Last night after an in-depth discussion with the President regarding COVID-19 testing, he elected to proceed," the release reads. "This evening I received confirmation that the test is negative."

    "One week after having dinner with the Brazilian delegation in Mar-a-Lago, the President remains symptom-free," he added. "I have been in daily contact with the CDC [Centers for Disease Control and Prevention] and White House Coronavirus Task Force, and we are encouraging the implementation of all their best practices for exposure reduction and transmission mitigation."

    Midler is rarely shy about posting her political opinions, which are typically very critical of the Trump administration, on social media. That’s been true during the coronavirus outbreak as well. She even pinned a tweet to her profile with a quote that Trump gave during a press conference in which he declined to take any responsibility for its spread.

    Rob Reiner called for Donald Trump to be removed from office due to his handling of the ongoing coronavirus pandemic.

    The 73-year-old actor and director took to Twitter on Monday to criticize Trump and his administration's response to the coronavirus outbreak that continues to spread throughout the world.

    “We will get through this. But unfortunately not with the help of this President,” Reiner wrote. “First he must be removed from the public square to let competent experts take over, then he must be removed from office to allow US to heal.”

    Donald Trump has faced harsh rebukes from his detractors both in Hollywood and in politics for seemingly downplaying the severity of the crisis and not equipping the country with adequate leadership or resources to combat the growing threat the virus poses.

    The coronavirus pandemic has infected more than 169,000 people and killed more than 6,500. The COVID-19 illness has caused mild or moderate symptoms for most patients, but severe symptoms have been more likely in the elderly or people with existing health problems. More than 77,000 people have recovered from it so far, mostly in China.

    This is hardly the first time that Reiner has used his Twitter account to publicly criticize the president and call for his removal from office. In February, he marked Presidents' Day with a message to his Democratic-leaning followers to vote in the November general election for whoever Trump’s opponent happens to be.

    Two days prior to his Presidents' Day tweet, Reiner further commented on the urgency with which he believes Trump, whom he calls a "cancer on Democracy," needs to be voted out of office.

    “Unless we all pledge to unabashedly and passionately support whichever candidate emerges to oppose this cancer on our Democracy, the Revolutionary War will have been fought for nothing,” he wrote.

    One day prior, Reiner commented on climate change, noting that Trump is the single greatest thing standing in the way of doing something about it.

    “We are experiencing two existential crises in real time: The Degradation of our Democracy and our Planet. Since we are responsible for both, we can save both. The Removal of the Criminal in the WH is the first critical step,” he wrote on Feb. 14.
